If you appear in content on Zwap and want it removed, tell us. You don't need an account. We aim to act on image-based requests within hours.
Important: Most Zwap content auto-deletes after 24 hours. If you act fast, we can remove it from the platform. Even if it's already expired, we can take action on the uploader's account — please still report it.

These Terms of Service ("Terms") form a legally binding agreement between you and K2026417298 (South Africa) trading as Zwap, a private company registered in South Africa ("Zwap", "we", "us"). They govern your use of the Zwap mobile application, website, and related services (together, the "Service"). If you do not agree to these Terms, do not use the Service.
1. Where Zwap Operates
Zwap is offered to residents of the Republic of South Africa. The Service is built around South African nightlife and complies with South African law. While the Service may be technically accessible from outside South Africa, we do not actively offer or market it outside South Africa. If you access the Service from outside South Africa, you do so at your own risk and you remain responsible for complying with the laws of your own jurisdiction.
These Terms are governed by South African law and any dispute will be heard by the courts of South Africa.
2. Eligibility
You must be at least 18 years old to use the Service. Zwap is not for children, and we do not knowingly collect information from anyone under 18.
You must have the legal capacity to enter into a binding contract.
You must not be barred from using the Service under South African law.
You must not have been previously banned from the Service.
3. Your Account
You are responsible for keeping your login credentials secure. Don't share them.
You are responsible for everything that happens on your account.
If you suspect unauthorised access, contact us immediately at support@zwaptech.net.
You must use accurate information when registering. Impersonation and false identities are not allowed.
You may close your account at any time through the in-app settings.
4. The 24-Hour Rule (How Zwap Content Works)
Zwap is about what's happening now. Videos and their associated comments automatically disappear after 24 hours.
Every video you upload is automatically deleted from the public Service approximately 24 hours after upload.
Comments on a video expire when the video does.
After expiry, the video is no longer visible to other users.
In limited circumstances we may retain content for longer — for example, where it has been reported for safety reasons or where we are legally required to preserve it.
We do not allow users to download videos within the Service. However, screen recording and screenshots are technically possible on most devices and we cannot prevent them. By posting a video, you accept that other users may capture it through means outside our control.
5. Filming and Featuring Other People
This is the most important responsibility you accept when uploading to Zwap.
South African law — including POPIA, the Constitution, and common law privacy and dignity rights — protects every person's right to control how their image and personal information are used.
By uploading any video featuring identifiable people, you confirm and warrant that:
You have obtained clear, informed consent from every identifiable person in the video before uploading it;
You have the legal right to film at the location shown;
No-one in the video is under 18;
No-one in the video is unable to meaningfully consent (heavily intoxicated, asleep, unconscious);
The video does not show any private space where people reasonably expect privacy.
If any person identifiable in your video later asks to have it removed, we will remove it without requiring you to agree.
6. Acceptable Use
You agree to follow our Community Guidelines. In summary, you must not use the Service to: post sexual or intimate content; post content involving anyone under 18; post violence, hate speech, harassment, or illegal activity; share personal information without consent; impersonate others; upload content you don't own; spam or scam; or interfere with the Service technically.
7. Your Content
You keep ownership of the content you submit. By submitting it, you grant Zwap a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, display, and distribute that content for the purpose of operating the Service. This licence ends when your content is deleted from our systems (within 24 hours for most videos).
8. Reporting and Takedown
If you see content that breaks these Terms, the Community Guidelines, or the law, please report it. There's an in-app Report button on every video, comment, and profile. If you appear in a video and want it removed, you can request removal through the Report button or our Takedown Policy. You don't need a Zwap account.
9. Service Availability and Changes
We try to keep the Service available, but we don't promise uninterrupted access. We may add, change, or remove features at any time. We may stop offering the Service entirely, with reasonable notice.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you break these Terms or the Community Guidelines, your account is used for unlawful purposes, or we are required to do so by law.
11. Disclaimers and Liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we don't promise the Service will be error-free. We don't endorse User Content. Our total liability to you in any 12-month period will not exceed ZAR 1,000.
Nothing in these Terms limits any right you have under the South African Consumer Protection Act 68 of 2008 that cannot lawfully be limited.
12. Indemnity
You agree to indemnify Zwap from any claim arising from your User Content, your breach of these Terms, your violation of any law, or your violation of any third party's rights — including any person who appears in your content.
13. Disputes
Contact us first at support@zwaptech.net. If we can't resolve it, you may refer the matter to the Information Regulator (for personal information complaints), the National Consumer Commission, or the courts of South Africa. These Terms are governed by South African law.
14. General
If any part of these Terms is unenforceable, the rest still applies. We may update these Terms — when we make significant changes, we'll notify you in the app. Continued use after changes means you accept the updated Terms.

2. Where Zwap Operates
Zwap is offered to residents of South Africa. This Privacy Policy is built around POPIA. If you access the Service from outside South Africa, your personal information will be processed under South African law.

Account information: phone number, email address, username, display name, date of birth, profile picture.
Authentication: password (hashed using BCrypt — we never see your actual password), PIN (hashed), verification codes.
User Content: videos, comments, replies, direct messages, reactions.

Device information: model, OS version, app version, language.
Network information: IP address, mobile carrier (used for security and abuse prevention).
Approximate location: based on IP address. Precise GPS only if you grant permission.

Other users may post content that includes information about you. If you object, you can request removal through our Takedown Policy.
4. Lawful Basis Under POPIA
We process your personal information based on:
Performance of contract (POPIA section 11(1)(b)): to create your account and deliver the Service.
Legitimate interests (section 11(1)(f)): to keep the Service safe, prevent fraud, enforce our Terms, improve features, and defend legal claims.
Consent (section 11(1)(a)): for optional features like precise location and push notifications. You can withdraw consent at any time.
Compliance with the law (section 11(1)(c)): to respond to court orders, subpoenas, and lawful requests.
5. The 24-Hour Rule and What We Keep
Most content on Zwap is deleted from the public Service approximately 24 hours after upload.
Videos: removed approximately 24 hours after upload.
Comments and replies: expire with the video they're on.
Reactions: expire with the content.
Direct messages: kept until you or the recipient deletes them, or your account is deleted.
What we keep longer than 24 hours:
Account information: while your account is active, plus a short period after deletion.
Reported content under investigation: until the investigation closes.
Content under legal preservation: up to 90 days, or longer if law requires.
Hashes of content removed for serious violations: indefinitely, to prevent re-uploading.
Upload logs: 12 months, for abuse prevention and legal defence.
Records required by law (tax, legal requests): as long as required.
When you delete your account, we delete or anonymise your account information within 30 days.
6. Who We Share Your Information With
We do not sell your personal information.
Other users
Your username, profile picture, and content you post are visible to other users in the way the Service is designed.
Service providers (Operators under POPIA)
Hosting: Railway (United States) — server hosting and database.
Email delivery: Resend, on our zwaptech.net domain.
Push notifications and analytics: as listed in the in-app version of this Policy.
Operators only process your information on our written instructions, at a level consistent with POPIA.
Cross-border transfers
Some providers store data outside South Africa. POPIA permits this where adequate protection is in place. We use written contracts requiring our providers to protect your information.
Law enforcement and legal process
We may share information where compelled by valid legal process, where there is an immediate threat to life or safety, or where necessary to investigate violations of our Terms.
7. How We Protect Your Information
Passwords hashed using BCrypt.
Sensitive credentials stored via SecureStorage on your device.
API access uses JWT authentication.
Connections encrypted in transit.
Access to user data is restricted to authorised personnel.
If a security breach affects your personal information, we will notify you and the Information Regulator as required by POPIA section 22.
8. Children
Zwap is not for anyone under 18. If we learn an account belongs to someone under 18, we will close it and delete the data.
9. Your Rights Under POPIA
Right of access (section 23): ask what we hold about you.
Right to correction (section 24): correct inaccurate or outdated information.
Right to deletion (section 24): delete information we no longer have a basis to keep.
Right to object (section 11(3)): object to processing based on legitimate interests.
Right to withdraw consent (section 11(2)(b)): withdraw consent at any time.
Right to complain to the Information Regulator: inforeg@justice.gov.za, https://inforegulator.org.za.

10. Changes
We may update this Privacy Policy. When we make material changes, we'll notify you in the app or by email. The "Last updated" date at the top will reflect the most recent change.

Zwap is a 24-hour social platform for South African nightlife. These Community Guidelines explain what's allowed on Zwap and what isn't. They form part of our Terms of Service. Breaking them can result in content removal, account restrictions, suspension, permanent banning, and in serious cases reporting to law enforcement.
1. Who Can Use Zwap
You must be at least 18 years old.
Use your real identity. Don't impersonate others.
One person, one account.
2. The 24-Hour Rule
Most content on Zwap disappears about 24 hours after upload. Videos, comments, and reactions expire together. Two important things:
We don't allow downloads inside the app. Screenshots and screen recordings are technically possible and we cannot prevent them. By posting, you accept that others may capture your content using tools outside our control.
Some content is preserved beyond 24 hours when reported for serious safety reasons or required by legal process.
3. Filming Other People — The Most Important Rule
Before you upload any video featuring identifiable people, you must have their permission.
South African law — POPIA, the Constitution, common law privacy rights — protects every person's right to control how their image is used. This applies in clubs, restaurants, and other semi-public venues.
As an uploader, you must:
Get clear, informed consent from anyone identifiable in your video before posting.
Respect venue rules. Some places prohibit filming.
Never film people who cannot meaningfully consent (heavily intoxicated, asleep, unconscious).
Never film in private spaces where people reasonably expect privacy.
Remove a video immediately if someone in it asks you to.
If you appear in someone else's video and want it removed, you can request removal even without a Zwap account. Use the Report button, email takedown@zwaptech.net, or fill out the takedown form on this site.
4. Content That Is Strictly Prohibited
4.1 Sexual and intimate content
Nudity, partial nudity, or sexually explicit content of any kind.
Intimate images shared without consent. This is a criminal offence under the Cybercrimes Act 19 of 2020.
Content sexualising or suggestively depicting any person.
Sexual solicitation, prostitution, or escort services.
4.2 Content involving minors
Any content featuring people under 18, whether sexual or not.
Content sexualising minors will be reported to SAPS and the Film and Publication Board immediately.
4.3 Violence and dangerous content
Graphic violence, gore, or footage of physical assault.
Content promoting, glorifying, or instructing how to commit violence.
Threats of violence.
Animal cruelty.
Dangerous activities likely to cause serious injury.
4.4 Hate speech and discrimination
Content attacking people based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
Music, video, or content you don't own or have a licence to use.
Counterfeit goods or trademark infringement.
4.9 Self-harm and suicide
Content promoting, glorifying, or instructing self-harm or suicide.
Content promoting eating disorders.

5. Alcohol and Drugs
Adults consuming alcohol in licensed venues is allowed. But: don't promote excessive or dangerous drinking, don't depict illegal drug use, don't show alcohol consumed by anyone visibly underage, and alcohol-related content must comply with the Liquor Act and ARA Code.
6. Reporting Violations
Tap Report on any video, comment, or profile. Email takedown@zwaptech.net. Or use the takedown form on this site (no account required). For urgent safety: SAPS on 10111.
7. How We Enforce
When we receive a report or detect a violation, we may: remove the content, issue a warning, restrict account features, suspend or permanently ban the account, or report to law enforcement. Severe violations — content involving minors, non-consensual intimate imagery, threats of violence, hate speech — typically result in immediate permanent ban.
8. Appeals
If your content is removed and you believe it was a mistake, email appeals@zwaptech.net. Appeals are reviewed by a different person than made the original decision. We aim to respond within 7 days.
9. Changes
We may update these Guidelines. When we make significant changes, we'll notify you in the app. Continued use means you accept the updated Guidelines.

1. About This Policy
This Takedown Policy explains how anyone — whether or not you have a Zwap account — can request removal of content from Zwap. It also explains how we handle reports, how preserved content is dealt with, and how appeals work. This Policy forms part of our Terms of Service.
2. The 24-Hour Rule and Why You Should Still Report
Most content on Zwap automatically expires about 24 hours after upload. Reporting is still important because:
Urgent reports get reviewed faster than the 24-hour expiry — often within hours.
Even after content has expired, we keep records of who posted what. Repeat offenders can be banned based on past activity.
For serious safety concerns, we preserve content beyond 24 hours.
Screenshots of expired content can still be reported. We will act against the original uploader's account.
3. Who Can Submit a Request
A person who appears identifiably in a video and did not consent.
A person whose personal information appears in content on Zwap.
A copyright or trademark holder.
A parent or legal guardian on behalf of someone under 18.
A legal representative.
Any person reporting content that violates our Community Guidelines or SA law.
4. Categories and Response Times
Urgent — typically within hours
Non-consensual intimate imagery.
Content involving anyone under 18.
Content that puts physical safety at immediate risk.
Child sexual abuse material — removed immediately and reported to SAPS.
Priority — within 24 hours
A person appearing in a video without consent.
Personal information shared without consent.
Hate speech and severe harassment.
Defamatory content.
Standard — within 7 days
Copyright or trademark claims.
Spam, scams, impersonation.
Other Community Guidelines violations.
5. How to Submit
Use the in-app Report button if you have an account. Otherwise email takedown@zwaptech.net or use the takedown form on this site. Include: your name and contact details, your relationship to the content, where to find it, the reason for the request, and any supporting evidence.
6. What Happens Next
We acknowledge receipt within 24 hours.
A trained reviewer assesses the request.
For urgent cases, we may immediately remove or restrict the content while we investigate.
The uploader is usually notified and given a chance to respond.
We inform you of our decision.
Both parties may appeal.
7. Image-Based Privacy Requests
If you appear in a video on Zwap and don't want to be there, we will remove it. You don't need to prove the content is illegal. Your right to control your own image is enough under POPIA and SA common law.
To request removal: provide a description of the video, identify yourself in it, and submit a current photo for identity verification (used only to confirm you are the person, then deleted).
8. Counter-Notice from Uploaders
If your content is removed and you believe the removal was incorrect, you may submit a counter-notice with your contact details, identification of the content, evidence of consent or rights, and a statement that the removal was in error.
9. Appeals
Email appeals@zwaptech.net within 30 days of the decision. Appeals are reviewed by a different person than made the original decision. Most are resolved within 7 days.
10. Content Preserved Beyond 24 Hours
We preserve a copy of content beyond its normal lifespan when reported for serious safety reasons (up to 90 days), subject to a valid legal preservation request, or needed for legal defence. Preserved content is not visible to other users.
11. Repeat Offenders
Users who repeatedly upload violating content face escalating consequences up to permanent termination. Three valid copyright strikes within 12 months result in account termination.
12. Abuse of This Process
Submitting requests in bad faith — to harass, censor lawful content, or based on knowingly false statements — is itself a violation of our Guidelines and may be unlawful.
13. Law Enforcement
Law enforcement requests should be sent to legal@zwaptech.net. Because of the 24-hour expiry, we encourage preservation requests to be sent by email as soon as possible, even before formal process is complete. Preservation alone does not give law enforcement access — production still requires proper legal process.
14. Limitation of Liability
Zwap acts as an intermediary. Compliance with valid takedown requests is part of how we maintain our protected status under Chapter XI of the ECT Act. Removal is not an admission that content was unlawful.
